Terms and Conditions
This is a courtesy translation. In the event of any discrepancy, the Spanish version prevails.
1. Terms for Providers
- Description of the Service: Nexo is a SaaS platform that lets providers manage their schedules, bookings and client records.
- Accounts and Security: The Provider is responsible for keeping their access credentials confidential. One account per Provider is permitted.
- Acceptable Use: The Provider undertakes to use the platform solely to offer lawful professional services. Use for spam, unlawful activity or impersonation is strictly prohibited.
- Responsibility for Client Data: By using Nexo, the Provider acknowledges that they are the Data Controller for their clients' data. Nexo acts as Data Processor under the corresponding Data Processing Agreement inherent in the acceptance of these terms. The Provider is responsible for informing their own clients.
- Payments and Billing: Nexo does not act as an intermediary in payments between the Provider and their end client. Payments for Nexo Premium plan subscriptions are governed by the rates in force and are settled using the methods specified on the platform.
- Termination and Deletion: The Provider may delete their account at any time. Doing so triggers the permanent (cascading) deletion of their data and that of their clients held on Nexo.
- Governing Law and Jurisdiction: These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of [Your City].
2. Terms for End Clients (booking users)
- Relationship with the Provider: Clients interact with the Provider's public page, not with a Nexo account. Any booking is subject to the Provider's availability and confirmation.
- Payment for services: Payments for booked services are always made between the Client and the Provider. Depending on how the Provider has set things up, this happens in one of two ways:
- Outside the platform (the default): payment is direct and external, for example via Bizum, cash or bank transfer. Nexo only records whether a booking is paid or pending.
- With online payment: the Provider may enable card, Google Pay or Bizum payments through Stripe. In that case the payment is made to the Provider's own Stripe account, and the Provider is the merchant responsible for the transaction (merchant of record). Stripe is the entity that processes the payment; the funds never pass through a Nexo account, and Nexo charges no per-transaction fee.
- Privacy: The data entered in the booking form is managed by the Provider. GDPR rights requests must be addressed to them.
